This research aims to analyze the judge's considerations and the application of evidence
in a criminal case of sexual violence against a minor, as outlined in the Decision of the
Sangatta District Court Number 397/Pid.Sus/2024/PN SGT. The study focuses on two
main issues: how the judge's considerations were formed in rendering the verdict, and
how evidence was applied in accordance with Article 184 of the Indonesian Criminal
Procedure Code (KUHAP). This research uses a normative juridical method combined
with an empirical juridical approach by examining court decision documents, statutory
regulations, and relevant legal theories. The findings indicate that the judge's
considerations were not only based on juridical aspects but also included philosophical
and sociological elements. This is evident from the judge’s attention to the importance
of legal protection for children as victims of crime. Furthermore, the application of
evidence in this case complied with the provisions of Article 184 of the Criminal
Procedure Code, by using at least two valid and corroborative types of evidence. The
judge applied the theory of negative evidence according to the law, meaning that the
judge's conviction was formed based on the legally examined evidence presented
during the trial. Therefore, the judge's decision in this case reflects the principles of
justice and legal protection for children who are victims of sexual violence.
